Terms of Service

1. Acceptance of Terms

By accessing or using BersihBG (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to all of these Terms, you may not access or use the Service. These Terms apply to all visitors, users, and others who access or use the Service. We reserve the right to update these Terms at any time, and your continued use after changes constitutes acceptance of the updated Terms.

2. Description of Service

BersihBG is a free online platform that provides image, video, PDF, and text processing tools. These tools include but are not limited to background removal, image compression, format conversion, PDF manipulation, OCR text extraction, AI upscaling, and photo colorization. Some tools run entirely in your browser (client-side processing), while AI-powered tools are processed on our secure cloud servers. The Service is provided for lawful purposes only.

3. User Accounts

You may need to create an account to access certain features of the Service, particularly AI-powered tools. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorised use of your account. You may not create accounts through automated means or create multiple accounts for the purpose of circumventing usage limits.

4. Acceptable Use

You agree to use BersihBG only for lawful purposes and in accordance with these Terms. You may not: (a) upload content that you do not own or have the legal right to process; (b) upload content that is illegal, obscene, defamatory, or infringes on the rights of others; (c) attempt to disrupt or damage the Service, including denial-of-service attacks or hacking; (d) use automated scripts, bots, or scrapers to access the Service without our express permission; (e) reverse-engineer or attempt to extract the source code of our client-side or server-side software. Violation of these rules may result in immediate termination of your account.

5. Credits, Billing, and Subscriptions

Free accounts receive a monthly allocation of credits for AI-powered tools. Additional credits and features are available through VIP subscription plans. VIP subscriptions are billed monthly in Malaysian Ringgit (RM) and automatically renew unless cancelled before the renewal date. You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of the current billing period. Prices are subject to change with 30 days' notice. Refunds are provided on a case-by-case basis in accordance with Malaysian consumer law.

6. Intellectual Property

You retain all rights and ownership of the images, videos, PDFs, and other files you upload to BersihBG ("Your Content"). BersihBG claims no ownership over Your Content. You grant us a limited, temporary license to process Your Content solely for the purpose of providing the Service. BersihBG retains all rights, title, and interest in and to its software, brand name, logo, design, and technology ("BersihBG IP"). You may not use BersihBG IP without our prior written consent. The results generated by our AI tools are provided for your use, but we make no warranty regarding their originality or non-infringement.

7. Privacy

Your privacy is important to us. Our Privacy Policy, which is incorporated into these Terms by reference, explains how we collect, use, and protect your personal data and uploaded content. By using the Service, you consent to the collection and use of your information as described in our Privacy Policy.

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT ANY WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR ACCURACY OF RESULTS. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE FROM VIRUSES OR OTHER HARMFUL COMPONENTS. AI-POWERED TOOLS PROVIDE RESULTS BASED ON MACHINE LEARNING MODELS AND MAY NOT ALWAYS PRODUCE ACCURATE OR DESIRED OUTPUTS.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, BERSIHBG AND ITS OPERATORS, EMPLOYEES, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATING TO YOUR USE OF THE SERVICE. THIS INCLUDES, WITHOUT LIMITATION, DAMAGES FOR LOSS OF PROFITS, DATA, USE, OR GOODWILL. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU HAVE PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.

10. Termination

We reserve the right to suspend or terminate your access to the Service at any time, with or without cause or notice, including if you violate these Terms. Upon termination, your right to use the Service will immediately cease. You may terminate your account at any time by deleting your account through the settings page. Provisions of these Terms that by their nature should survive termination, including intellectual property, disclaimers, and limitations of liability, shall survive.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Malaysia. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of Malaysia.
